Terms of service.
These Terms of Service govern access to and use of the Prism platform. This is placeholder copy — replace with your finalized Terms before launch.
1. Acceptance of terms
By creating a Prism account or using the Prism services, you agree to these Terms.
2. The service
Prism provides a SaaS suite for fitness facility operators, comprising the Staff console, Member app, Kiosk, Signage, and Studio applications.
3. Accounts & access
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
4. Payments
Subscription fees are billed monthly or annually based on the tier you select. Stripe processing fees are billed by Stripe directly.
5. Customer data
You retain ownership of all customer and member data. We process it solely to provide the services and as described in our Privacy Policy.
6. Acceptable use
You agree not to use the services to violate applicable law, infringe intellectual property rights, or send unsolicited communications.
7. Termination
Either party may terminate the agreement on 30 days' notice. Customer data is exportable for 90 days after termination.
8. Warranty disclaimer
The services are provided "as is." We make no warranties beyond those expressly stated in this agreement and any executed Order Form.
9. Limitation of liability
Liability is capped at fees paid in the preceding 12 months. Neither party is liable for indirect or consequential damages.
10. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles.
